A Roofer SWMS (Safe Work Method Statement) is a written document that outlines the high-risk work activities involved in a roofing job. It details the specific hazards workers will face, the potential risks, and the control measures put in place to keep everyone safe. Under Australian law, this is not just paperwork. For most roofing jobs, it is a legal requirement.

Think of it as a practical safety plan. It tells the crew how to do the job without getting hurt. For a Person Conducting a Business or Undertaking (PCBU), such as a roofing contractor or construction company, the SWMS is the primary tool to meet the duty of care under the Work Health and Safety Act 2011.

The document must be specific to the site. It is not enough to have a general statement about roofing. It must address the exact height, the type of roof, the weather conditions, and the specific machinery being used. If an inspector arrives on site, this is the first document they will ask to see.

When to Use This Document

You must use a SWMS for all "High Risk Construction Work" (HRCW). The Work Health and Safety Regulation 2011 (Regulation 291) explicitly includes roofing work in this category when there is a risk of a person falling more than 2 metres.

There are specific scenarios where a Roofer SWMS is mandatory:

  • Residential Re-roofing: If you are stripping tiles or tin from a house and there is a fall risk of two metres or more, you need a SWMS.
  • New Home Construction: Installing trusses, roofing battens, or metal sheeting on a new build falls under HRCW.
  • Commercial Roofing: Large-scale projects on warehouses, factories, or office blocks require a comprehensive SWMS due to the height and complexity.
  • Work Near Asbestos: If the roof contains asbestos cement sheets, a SWMS is required to manage the risks of fibres and the brittle nature of the materials.
  • Work Near Powerlines: If the roofing work occurs near overhead electric lines, the SWMS must cover the specific exclusion zones and safe approach distances.

In Victoria, the requirements are nearly identical under the Occupational Health and Safety Regulations 2017. They refer to it as a "High Risk Construction Work" statement, but the function is the same.

If you are unsure, the safest approach is to have one. Not having a SWMS when it is required can lead to substantial fines and stop-work orders from regulators like SafeWork NSW, WorkSafe QLD, or WorkSafe VIC.

Key Sections and Required Elements

A compliant Roofer SWMS cannot be a blank page with a few ticks. The WHS Regulation 2011 (Regulation 299) sets out specific content that must be included. If these elements are missing, the document is considered invalid.

Statement of Work

The document must clearly state the high-risk construction work involved. You need to describe the job accurately. "Roofing work" is too vague. A good description would be "Installation of Colorbond roofing sheets on a single-story dwelling at 123 Smith Street, including the removal of existing terracotta tiles."

Hazards and Risks

You must identify the hazards associated with the work. For roofers, these are obvious but must be written down. Common hazards include falls from heights, falling objects, manual handling injuries, exposure to ultraviolet (UV) radiation, and contact with electricity. The SWMS must also assess the risk level, often using a risk matrix to determine if the risk is high, medium, or low before controls are applied.

Control Measures

This is the most critical section. You must describe the control measures to be implemented to minimise the risks. The Code of Practice: Managing the Risk of Falls in Housing Construction directs users to follow the Hierarchy of Controls.

You cannot simply write "Wear a harness." The SWMS must explain how you will prevent the fall in the first place. This might involve scaffolding, perimeter guardrails, or safety nets. If it is not reasonably practicable to use these higher-order controls, you must justify why you are relying on a fall-arrest system, such as a static line.

Monitoring and Review

The SWMS must describe how the control measures will be monitored and reviewed. This ensures the safety plan is not just written and forgotten. It requires active supervision. The document should outline how often inspections will happen and who is responsible for checking the safety equipment.

Signatures

Finally, the document must include the names and signatures of the Principal Contractor (if applicable) and the worker representative. It serves as proof that the workers have been consulted and understand the risks.

How to Write a Roofer SWMS (Step by Step)

Creating a compliant SWMS takes time and focus. While many businesses start with a template, you must customize it for the specific job. The "copy and paste" approach often leads to non-compliance and safety issues.

Step 1: Choose a Reliable Template

Start with a template from a reputable source, such as Master Builders Association or industry-specific safety providers. Ensure the template aligns with the current Code of Practice: Construction Work. A good template will have the fields required by Regulation 299 pre-formatted. Step 2: Define the Job Details

Fill in the header information accurately. Write the full site address and the date of work. Be specific about the scope. If you are using a crane to lift materials, write it down. If you are working on a steep pitch roof (greater than 26 degrees), note it. These details change the risk profile.

Step 3: Identify Site-Specific Hazards

Walk around the site before you start. Look for things that are not generic.

  • Are there overhead powerlines within 4 metres of the roof edge?
  • Is the roof made of brittle asbestos material?
  • Is the ground soft or uneven, which might affect scaffolding stability?
  • Are there strong winds forecast?

Add these specific hazards to the document. Regulators like SafeWork NSW warn strongly against generic documents that do not address the actual site conditions.

Step 4: Apply the Hierarchy of Controls

Go through each hazard and select a control measure. Start from the top of the hierarchy.

  1. Can you eliminate the risk? Can you pre-fabricate the roof on the ground and crane it into place? This is the safest option.
  2. Can you substitute the hazard? Can you use a scissor lift instead of ladders?
  3. Can you engineer a solution? This is the most common step for roofers. Install edge protection, scaffolding, or a static line. Reference the appropriate Australian Standards here, such as AS/NZS 1891.1 for fall-arrest systems.
  4. Use Administrative controls. This includes your SWMS, warning signs, and toolbox talks.
  5. Use PPE. List hard hats, safety glasses, and high-vis clothing.

Step 5: Define Inspection and Maintenance

State how you will keep the controls effective. For example, "Scaffolding will be inspected by a competent person prior to daily use." If you are using roof anchors, write when they were last certified. Anchor points need an inspection every 12 months.

Step 6: Conduct a Toolbox Talk

Print the document or load it onto a tablet. Gather the crew before work begins. Read through the SWMS with them. Ask if they understand the risks. Ask if they have suggestions for making the work safer. This consultation is a requirement under Section 48 of the WHS Act.

Step 7: Record Signatures

Every worker on the roof must sign the document. If a subbie or labourer arrives halfway through the day, they must sign the SWMS before they step onto the roof. This confirms they have read and understood the method statement.

Common Mistakes to Avoid

Many roofing businesses make the same errors when managing their safety paperwork. Avoiding these mistakes can help you avoid fines and, more importantly, keep your crew safe.

The Generic "One Size Fits All" Document

Using a generic SWMS for a metal roof job when you are actually working on fragile terra cotta tiles is a common error. Tiles behave differently. They can crack underfoot, leading to immediate falls. A generic document will miss the specific risk of fragility and the need for crawl boards. Regulators issue on-the-spot fines for this discrepancy because it shows the employer has not thought about the specific risks.

Keeping the SWMS in the Ute

There is a phenomenon where the SWMS lives in the folder in the site office or the ute. Inspectors often criticise this. The law states the SWMS must be "readily accessible" to workers on the roof. If a worker is on the ridge cap, they need to be able to recall the safety measures or have the document accessible nearby. While it doesn't need to be in their pocket, it cannot be locked in a vehicle down the street.

Relying Solely on PPE

Writing "Wear a harness" as your only control measure for a 4-metre fall is not compliant. The Hierarchy of Controls requires you to try to eliminate the hazard or use engineering controls first. You must explain why scaffolding or edge protection is not reasonably practicable before you rely on a harness. A SWMS that jumps straight to PPE is often seen as a sign of poor safety planning.

Neglecting Asbestos and Electrical Risks

Forgetting to check the roof age is a major oversight. If the building was built before 1990, there is a high chance it contains asbestos. Disturbing asbestos without a control plan is illegal. Similarly, failing to check the height of overhead powerlines can be fatal. Both hazards must be explicitly listed and managed in the SWMS.

Legal Considerations (AU)

Understanding the legal framework behind a Roofer SWMS is essential for business owners. The requirements are strict, and penalties for non-compliance are severe.

The Primary Duty of Care

Section 19 of the Work Health and Safety Act 2011 (Cth) establishes the Primary Duty of Care. The PCBU must ensure, so far as is reasonably practicable, the health and safety of workers. A SWMS is your evidence that you have taken steps to meet this duty. If an accident happens, the SWMS will be the first piece of evidence examined by the prosecutor.

State and Territory Variations

Most states have adopted the national model WHS laws.

  • New South Wales, Queensland, Western Australia, South Australia, Tasmania, Northern Territory, and ACT: Follow the WHS Act and WHS Regulations. They require a SWMS for HRCW as defined in Regulation 291.
  • Victoria: Uses the Occupational Health and Safety Act 2004 and the OHS Regulations 2017. While the wording differs, Victoria requires a written "safe work method statement" for high-risk construction work, including roofing with a fall risk over 2 metres.

Admissible Evidence in Court

The Code of Practice: Construction Work is not legislation itself. However, under section 274 of the WHS Act, codes of practice are admissible in court proceedings. This means a court can look at your SWMS and compare it to the Code. If your document does not follow the Code’s guidelines, it can be used as evidence that you did not comply with your duty of care.

Privacy and Record Keeping

While the focus is on safety, there are data considerations. The SWMS contains worker signatures and potentially dates of birth or contact numbers. If your business has an annual turnover of more than $3 million, you must comply with the Privacy Act 1988. You must store these documents securely and ensure they are not used for purposes other than safety records.

Worker Consultation

Section 48 of the WHS Act requires PCBUs to consult with workers who carry out work. The SWMS process is a key consultation tool. You cannot write a SWMS in the office and hand it out without discussion. If you do not consult with your workers, you are breaching the Act, regardless of how good the document looks.

Can I write a SWMS by hand? Yes. The law does not require a typed document. However, it must be legible and contain all mandatory information. Many inspectors prefer digital records or typed documents to ensure they are readable.

Do I need a new SWMS every day? Not necessarily. You need a SWMS for every distinct "high risk construction activity." If the work is exactly the same and the conditions have not changed, the same SWMS can be used. However, if there is a change in weather, site conditions, or scope, the SWMS must be reviewed and amended.

How long do I need to keep the SWMS? You must keep the SWMS for the duration of the high-risk work. It is best practice to keep it for at least 2 years after the work is completed, as inspectors can investigate incidents retrospectively.

Do sub-contractors need to sign my SWMS? Yes. If they are performing high-risk work on your site, they must understand the safety measures. They can either sign your SWMS or provide their own that complies with the regulations. Their document must be consistent with your site safety rules.
