AFFIDAVIT OF JAMES SMITH

I, JAMES SMITH of 42 Blue Street, Brisbane, Queensland, Builder, MAKE OATH AND SAY as follows:

1. My name is James Smith and I am the Director of Smith Builds Pty Ltd (ABN 12 345 678 901).

2. The facts set out in this affidavit are within my own knowledge and I believe them to be true.

3. On 14 January 2023 I entered into a written contract with Mr John Brown to renovate the kitchen at 10 Green Road, Paddington. Please refer to Annexure "A" which is a true copy of the Building Contract.

4. Under the terms of the contract, Mr Brown agreed to pay the total sum of $30,000.00.

5. The contract specified that progress payments were due at certain stages of the build.

6. I completed the demolition stage on 20 January 2023. I notified Mr Brown via email that the invoice for the first progress payment of $9,000.00 was due. Please refer to Annexure "B" which is a true copy of the email sent on 20 January 2023.

7. As at the date of this affidavit, Mr Brown has not paid the invoice for $9,000.00.

8. I have performed all obligations required of me under the contract up to this date.

9. The amount of $9,000.00 remains owing and outstanding.

10. I make this affidavit in support of my claim against Mr Brown in the Magistrates Court of Queensland.
