EMPLOYMENT AGREEMENT

BETWEEN:
Smith & Sons Plumbing Pty Ltd ABN: 12 345 678 901 of 123 Trade Street, Parramatta NSW 2150 (the Employer)
AND
David John Jones of 45 Blue Street, Auburn NSW 2144 (the Employee)
1. COMMENCEMENT AND POSITION
1.1 The Employer agrees to employ the Employee and the Employee agrees to work for the Employer in the position of Qualified Plumber.
1.2 The employment will commence on 1 June 2024.
1.3 The Employee will be classified as Full Time.
1.4 The Employee will perform the duties outlined in Annexure A attached to this agreement, as well as any other lawful and reasonable duties directed by the Employer.
2. PROBATION
2.1 The first 3 months of employment will be a probationary period.
2.2 During this period, the Employer will monitor the Employees performance and suitability for the role.
2.3 The notice period required to terminate employment during probation is 1 week.
3. REMUNERATION
3.1 The Employee will be paid a base rate of $1350.00 per Week.
3.2 Payment will be made Weekly into the Employees nominated bank account.
3.3 The Employee is entitled to the following allowances:
- Tool Allowance: $20.00 per week
- Travel Allowance: $50.00 per week
3.4 The Employee will be paid in accordance with the Plumbing and Fire Sprinklers Services Award 2020.
4. HOURS OF WORK
4.1 The ordinary hours of work are 38 hours per week, between the hours of 7:00 am and 3:30 pm, Monday to Friday.
4.2 The Employee will take a meal break of 30 minutes after no more than 5 hours of work.
4.3 Overtime is any work performed outside the ordinary hours. The rate for overtime is double time.
5. LEAVE ENTITLEMENTS
5.1 The Employee is entitled to four weeks annual leave per year. The Employee must request leave in writing at least 4 weeks prior to the intended date.
5.2 The Employee is entitled to 10 days personal leave per year. The Employee must notify the Employer by 8:00 am on the day of absence. A medical certificate is required for absences longer than 2 days.
6. SUPERANNUATION
6.1 The Employer will pay superannuation contributions into the Employees nominated fund AustralianSuper.
6.2 Contributions will be calculated at the Superannuation Guarantee rate on the Employees Ordinary Time Earnings.
7. WORKPLACE HEALTH AND SAFETY
7.1 The Employee agrees to follow all reasonable safety instructions and policies of the Employer.
7.2 The Employee must wear all provided PPE including steel cap boots, high vis shirts and safety glasses.
8. CONFIDENTIALITY AND INTELLECTUAL PROPERTY
8.1 The Employee must not share client lists or pricing schedules with anyone outside the business.
8.2 Any diagrams or plans created by the Employee remain the property of Smith & Sons Plumbing Pty Ltd.
9. TERMINATION
9.1 Either party may terminate this employment by providing notice in writing.
9.2 The minimum notice periods are:
- Up to 1 year: 2 weeks
- 1 to 3 years: 3 weeks
- 3 to 5 years: 4 weeks
9.3 The Employer may dismiss the Employee without notice for serious misconduct such as theft or intoxication at work.
10. DISPUTE RESOLUTION
10.1 The parties agree to discuss any disputes directly.

Note: This example uses the Plumbing Award as the reference. The base rate of $1350 aligns with Level 3 or 4 in that award (rates change annually, so always verify). The probation period is set to 3 months which is common for trade roles. The contract specifically mentions PPE requirements because WHS in construction is strict. The 'Tool Allowance' is a standard trade allowance.
