EQUIPMENT HIRE AGREEMENT
1. PARTIES
This Agreement is made on the 14th day of March, 2024.
Between:
The Owner: Apex Construction Supplies Pty Ltd ABN: 12 345 678 901 Address: 25 Builder Street, Parramatta NSW 2150 (“the Owner”)
And:
The Hirer: Smith & Sons Landscaping ABN: 98 765 432 109 Address: 12 Garden Lane, Blacktown NSW 2148 (“the Hirer”)
2. EQUIPMENT
The Owner agrees to hire to the Hirer the equipment described in Schedule 1 (“the Equipment”).
3. HIRE PERIOD
The hire period will commence at 8:00 am on 15 March, 2024 and will conclude at 5:00 pm on 22 March, 2024.
Time is of the essence. The Hirer must return the Equipment by the conclusion time. Any delay may incur additional charges at the rate of $50.00 per hour or part thereof.
4. HIRE CHARGES
The Hirer agrees to pay the Owner the hire fees as set out in Schedule 1.
5. BOND AND PAYMENT
The Hirer must pay a security bond of $500.00 prior to taking possession of the Equipment. This bond may be used by the Owner to cover any damage, loss, or unpaid fees.
Payment of the hire fees is due within 7 days of the invoice date.
6. CONDITION OF EQUIPMENT
The Hirer acknowledges that they have inspected the Equipment and found it to be in good working order and condition, save for any defects noted in Schedule 1.
7. INSURANCE
Option A (Hirer insures): The Hirer must maintain insurance for the Equipment for the full value of $25,000.00 against loss, theft, and damage for the duration of the hire period. The Hirer must provide the Owner with a certificate of currency prior to collection.
8. OBLIGATIONS OF THE HIRER
The Hirer agrees to: a) Use the Equipment only for its intended purpose and in a proper and workmanlike manner. b) Not remove any safety guards or warning labels from the Equipment. c) Not repair or alter the Equipment without the written consent of the Owner. d) Keep the Equipment clean and secure when not in use. e) Not allow any other person to use the Equipment without the Owner’s written permission.
9. LIABILITY AND INDEMNITY
The Hirer is liable for any loss, damage, or theft of the Equipment occurring during the hire period.
The Hirer agrees to indemnify and keep indemnified the Owner against any and all claims, liabilities, losses, damages, costs, and expenses (including legal fees) arising out of or in connection with the use of the Equipment by the Hirer.
10. MAINTENANCE AND REPAIRS
The Hirer must notify the Owner immediately of any fault or breakdown of the Equipment.
Routine servicing and maintenance required due to normal wear and tear are the responsibility of the Owner. Repairs required due to negligence, misuse, or accident by the Hirer are the responsibility of the Hirer.
11. TERMINATION
The Owner may terminate this Agreement immediately by written notice if the Hirer breaches any term of this Agreement.
The Hirer may terminate this Agreement by giving 2 days written notice to the Owner. In such cases, the Hirer must return the Equipment and pay hire fees up to the date of return.
12. RETURN OF EQUIPMENT
Upon the conclusion of the hire period, the Hirer must return the Equipment to the Owner’s premises at 25 Builder Street, Parramatta NSW 2150.
The Owner will inspect the Equipment upon return. If the Equipment is returned in a clean, undamaged, and working condition, the Owner will refund the bond within 5 days.
13. GOVERNING LAW
This Agreement is governed by the laws of New South Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of that state.

In this example, the parties are two businesses. The Owner, Apex Construction Supplies, is hiring a mini skid steer to Smith & Sons Landscaping. The agreement specifies the exact dates and times to ensure there is no confusion about when the machine must be returned. The bond of $500 protects the Owner against minor damages.
