EQUIPMENT RENTAL AGREEMENT

This Agreement is made on the 14th day of June 2024

BETWEEN

Apex Plant Hire Pty Ltd (the "Owner") ABN: 12 345 678 901 Address: 100 Industrial Drive, Albion QLD 4010

AND

Smith Constructions Pty Ltd (the "Hirer") ACN: 98 765 432 109 Address: 25 Builder Lane, Paddington QLD 4064

1. BACKGROUND

The Owner owns certain equipment described in Schedule 1. The Hirer wishes to hire that equipment from the Owner for the period and on the terms set out in this Agreement.

2. HIRE PERIOD

The Owner agrees to hire the Equipment to the Hirer commencing on 17 June 2024 at 7:00 AM and ending on 21 June 2024 at 5:00 PM (the "Hire Period").

3. HIRE CHARGES

3.1 In consideration for the hire of the Equipment, the Hirer agrees to pay the Owner the sum of $2,000.00 (the "Hire Charge").

3.2 The Hire Charge is calculated at a rate of $500.00 per Day.

3.3 The Hirer must pay a deposit of $500.00 prior to the commencement of the Hire Period. The Owner may deduct from this deposit any amounts owed by the Hirer under this Agreement.

4. PAYMENT TERMS

4.1 The Hirer must pay the Hire Charge to the Owner by Direct Deposit.

4.2 Payment is due within 7 days of the date of the invoice.

Notes

Key decisions made in this example:

  1. Entities: Both parties are companies (Pty Ltd), so the specific consumer guarantees regarding fitness for purpose under the Australian Consumer Law do not apply in the same way they would for a consumer hire.
  2. Specific Dates: Used exact dates and times (17 June 7:00 AM) to avoid ambiguity about when the hire fee clock starts and stops.
  3. Deposit: Set at 25% of the total hire charge to cover fuel top-up or minor incidental damage.
