Gift Card Terms and Conditions

1. Introduction These terms and conditions govern the issue and use of Gift Cards sold by Apex Plumbing Services Pty Ltd (ABN 12 345 678 901). By purchasing, accepting, or using a Gift Card, you agree to be bound by these terms and conditions.

2. Definitions

  • "Business" means Apex Plumbing Services Pty Ltd (ABN 12 345 678 901).
  • "Gift Card" means a gift card, voucher, or electronic gift code issued by the Business.
  • "Cardholder" means the person in possession of the Gift Card.
  • "Valid Until" means the expiry date printed on the Gift Card.

3. Purchase and Value

  • Gift Cards can be purchased online at www.apexplumbing.com.au or in-store at 100 Smith Street, Parramatta NSW.
  • Gift Cards are available in values ranging from $50 to $500.
  • The Business is not responsible for any Gift Card that is lost, stolen, or destroyed after it has been delivered to the purchaser or Cardholder.

4. Expiry

  • This Gift Card is valid for a period of three (3) years from the date of purchase.
  • The "Valid Until" date is printed on the front of the Gift Card or included in the email for electronic cards.
  • The Business will not honour the Gift Card after the expiry date.
  • The balance on this Gift Card is not redeemable for cash and cannot be refunded for cash, except as required by law.

5. Usage

  • The Gift Card can be used to purchase plumbing services or parts supplied by Apex Plumbing Services.
  • The Gift Card cannot be used to purchase other Gift Cards.
  • The Cardholder must present the Gift Card at the time of payment (or quote the code for electronic cards) to redeem the value.
  • If the purchase amount exceeds the balance on the Gift Card, the Cardholder must pay the difference using another payment method accepted by the Business.
  • If the purchase amount is less than the balance on the Gift Card, the remaining balance will remain on the Gift Card for future use. No change will be given.

6. Restrictions

  • The Gift Card cannot be redeemed for cash.
  • No administration or account keeping fees apply to this Gift Card.
  • The Business reserves the right to refuse to accept a Gift Card if it suspects fraud or if the card has been tampered with.
  • The Gift Card remains the property of the Business.

7. Loss or Theft

  • The Business is not liable for the replacement of lost, stolen, or destroyed Gift Cards unless the Cardholder can provide proof of purchase and the unique card number, and the card has been registered with the Business.
  • Please treat the Gift Card like cash.

8. System Errors

  • The Business is not liable for any failure or delay in processing a Gift Card transaction due to technical issues, system failures, or internet connectivity issues.

9. Changes to Terms

  • The Business may vary these terms and conditions at any time. However, any variation will not affect a Gift Card that has already been purchased.

10. Governing Law

  • These terms and conditions are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

11. Contact Information

Notes

Notes on Key Decisions:

  • Validity: Clause 4 sets the expiry to three years, which complies with the minimum 3-year requirement under the Competition and Consumer Act 2010.
  • No Fees: Clause 6 explicitly states no administration fees apply, complying with the ban on post-sale fees that reduce value.
  • No Cash Out: Clause 5 clarifies that change is not given. This is standard business practice to encourage customers to return.
  • Jurisdiction: Clause 10 specifies New South Wales as the governing law because the business is located in Parramatta.
  • Loss or Theft: Clause 7 clarifies the 'cash-like' nature of the card. Unless the business registers specific cards, they generally do not replace lost cards to prevent fraud.
