SUBCONTRACTOR AGREEMENT

This Agreement is made on: 15/10/2023

BETWEEN:

BuildRight Constructions Pty Ltd (ABN: 12 345 678 901) of 100 Builder Street, Sydney NSW 2000 (“The Head Contractor”)

AND:

Sparky Solutions (ABN: 98 765 432 109) of 50 Volt Lane, Parramatta NSW 2150 (“The Subcontractor”)

1. BACKGROUND

The Head Contractor has been engaged to provide services for the Westfield Residential Development located at 200 George Street, Sydney NSW (“the Project”).

The Head Contractor wishes to engage the Subcontractor to perform the electrical rough-in and fit-off for Units 1-10.

2. ENGAGEMENT AND SCOPE OF WORK

2.1 The Subcontractor is engaged to supply all labour, materials, and plant to complete the electrical works.

4. PRICE AND PAYMENT

4.1 The Head Contractor agrees to pay the Subcontractor the sum of $50,000.00 (excluding GST).

4.3 Payment Milestones: (a) Deposit: $5,000.00 upon signing. (b) Progress Payment 1: $20,000.00 upon completion of rough-in for all units. (c) Final Payment: $25,000.00 upon Practical Completion.

4.5 The Head Contractor will pay within 14 days.

6. INSURANCE AND INDEMNITY

6.1 The Subcontractor maintains Public Liability Insurance for $20,000,000.

7. WORK HEALTH AND SAFETY (WHS)

7.2 The Subcontractor has provided a Safe Work Method Statement (SWMS) for working at heights.

11. TERMINATION

11.2 The Head Contractor may terminate immediately if the Subcontractor fails to rectify defective cabling within 5 days of notice.

13. GOVERNING LAW

13.1 This Agreement is governed by the laws of New South Wales.
