EMPLOYMENT AGREEMENT

1. COMMENCEMENT AND POSITION

1.1 The Employer agrees to employ the Employee and the Employee agrees to work for the Employer in the position of [Job Title].

1.2 The employment will commence on [Start Date].

1.3 The Employee will be classified as [Full Time / Part Time / Casual].

1.4 The Employee will perform the duties outlined in Annexure A attached to this agreement, as well as any other lawful and reasonable duties directed by the Employer.

2. PROBATION

2.1 The first [Number] months of employment will be a probationary period.

2.2 During this period, the Employer will monitor the Employees performance and suitability for the role.

2.3 The notice period required to terminate employment during probation is [Number] weeks.

3. REMUNERATION

3.1 The Employee will be paid a base rate of $[Amount] per [Hour / Week / Year].

3.2 Payment will be made [Weekly / Fortnightly / Monthly] into the Employees nominated bank account.

3.3 The Employee is entitled to the following allowances:

3.4 The Employee will be paid in accordance with the [Name of Modern Award or Enterprise Agreement], if applicable. If the rate in this agreement is lower than the minimum rate in the Award, the Employer will pay the Award rate.

4. HOURS OF WORK

4.1 The ordinary hours of work are [Number] hours per week, between the hours of [Start Time] and [End Time].

4.2 The Employee will take a meal break of [Number] minutes after no more than 5 hours of work.

4.3 Overtime is any work performed outside the ordinary hours or on weekends and public holidays. The rate for overtime is [Rate].

5. LEAVE ENTITLEMENTS

5.1 The Employee is entitled to annual leave as per the National Employment Standards. The Employee must request leave in writing at least [Number] weeks prior to the intended date.

5.2 The Employee is entitled to personal and carers leave. The Employee must notify the Employer as soon as possible if they are unable to attend work due to illness or emergency. A medical certificate may be required for absences longer than [Number] days.

5.3 The Employee is entitled to paid parental leave in accordance with the Fair Work Act 2009.

6. SUPERANNUATION

6.1 The Employer will pay superannuation contributions into the Employees nominated fund [Fund Name].

6.2 Contributions will be calculated at the compulsory Superannuation Guarantee rate on the Employees Ordinary Time Earnings.

7. WORKPLACE HEALTH AND SAFETY

7.1 The Employee agrees to follow all reasonable safety instructions and policies of the Employer.

7.2 The Employee must wear all provided Personal Protective Equipment (PPE) while on site.

7.3 The Employee must report any hazards or unsafe work practices immediately.

8. CONFIDENTIALITY AND INTELLECTUAL PROPERTY

8.1 The Employee must not use or disclose any confidential information belonging to the Employer during or after employment, except when performing their duties.

8.2 Any intellectual property created by the Employee during their employment remains the sole property of the Employer.

9. TERMINATION

9.1 Either party may terminate this employment by providing notice in writing.

9.2 The minimum notice periods are based on the Employees period of continuous service:

  • Up to 1 year: [Number] weeks
  • 1 to 3 years: [Number] weeks
  • 3 to 5 years: [Number] weeks
  • 5 years or more: [Number] weeks

9.3 The Employer may pay out the notice period instead of requiring the Employee to work it.

9.4 The Employer may dismiss the Employee without notice in cases of serious misconduct.

10. DISPUTE RESOLUTION

10.1 The parties agree to attempt to resolve any disputes relating to this agreement through genuine discussion.

10.2 If the dispute cannot be resolved at the workplace level, the parties may refer the matter to the Fair Work Commission.
