EQUIPMENT RENTAL AGREEMENT

BETWEEN

(collectively referred to as the "Parties")

1. BACKGROUND

The Owner owns certain equipment described in Schedule 1. The Hirer wishes to hire that equipment from the Owner for the period and on the terms set out in this Agreement.

2. HIRE PERIOD

The Owner agrees to hire the Equipment to the Hirer commencing on [Start Date] at [Start Time] and ending on [End Date] at [End Time] (the "Hire Period").

3. HIRE CHARGES

3.1 In consideration for the hire of the Equipment, the Hirer agrees to pay the Owner the sum of $[Total Amount] (the "Hire Charge").

3.2 The Hire Charge is calculated at a rate of $[Rate] per [Day/Week/Hour].

3.3 The Hirer must pay a deposit of $[Deposit Amount] prior to the commencement of the Hire Period. The Owner may deduct from this deposit any amounts owed by the Hirer under this Agreement.

4. PAYMENT TERMS

4.1 The Hirer must pay the Hire Charge to the Owner by [Payment Method e.g. Direct Deposit/Credit Card].

4.2 Payment is due within [Number] days of the date of the invoice.

5. ACCEPTANCE OF EQUIPMENT

The Hirer acknowledges that they have inspected the Equipment and that it is in good working order and condition, fair wear and tear excepted. The Hirer accepts the Equipment in the condition it is in at the start of the Hire Period.

6. OBLIGATIONS OF THE HIRER

6.1 The Hirer must: (a) Operate the Equipment in a proper and skilful manner; (b) Use the Equipment only for the purpose for which it was designed; (c) Not remove or alter any identification marks on the Equipment; (d) Keep the Equipment in their own possession and control and not sub-hire or part with possession of the Equipment; (e) Not do or permit to be done any act which would vitiate any insurance policy held by the Owner.

6.2 The Hirer must pay all costs associated with the operation of the Equipment, including fuel, oil, and consumables, unless otherwise agreed in writing.

7. MAINTENANCE AND REPAIRS

7.1 The Owner is responsible for maintaining the Equipment in a safe working condition, provided the Hirer notifies the Owner immediately of any defect or malfunction.

7.2 The Hirer is responsible for all costs of repair arising from damage to the Equipment caused by the Hirer, their employees, or agents, other than fair wear and tear.

8. RISK AND INSURANCE

8.1 Risk in the Equipment passes to the Hirer from the time the Equipment leaves the possession of the Owner until it is returned.

8.2 The Hirer must insure the Equipment to its full replacement value against all risks, including loss, theft, and damage, for the duration of the Hire Period.

8.3 The Hirer must hold Public Liability Insurance with a minimum cover of $[Amount] million.

9. LOSS OR DAMAGE

If the Equipment is lost, stolen, or damaged beyond repair, the Hirer must pay to the Owner the full replacement cost of the Equipment.

10. RETURN OF EQUIPMENT

The Hirer must return the Equipment to the Owner at [Return Location] on the End Date. The Hirer must ensure the Equipment is clean and free of debris.

11. DEFAULT

If the Hirer fails to pay any amount when due or breaches any term of this Agreement, the Owner may retake possession of the Equipment and terminate this Agreement without prejudice to its other rights.

12. WARRANTIES

Except as expressly stated in this Agreement, the Owner gives no warranties, express or implied, regarding the Equipment.

13. GOVERNING LAW

This Agreement is governed by the laws of [State/Territory, e.g., New South Wales]. The Parties submit to the non-exclusive jurisdiction of the courts of that State/Territory.
