Step 1: Consult with Your Workers

Under Section 47 of the WHS Act, you must consult with your workers when drafting the SWMS. You cannot write this in the office alone and hand it out. Ask your crew what they find difficult about the job. They are the ones handling the materials and machinery, so they know the real risks. If you have Health and Safety Representatives (HSRs), involve them too. This consultation is a legal requirement, and a document created without it can be deemed invalid.

Step 4: Apply the Hierarchy of Controls

Go through your list of hazards and assign controls. Do not rely on safety gear alone.

  • For manual handling: instead of just saying "Wear a back belt," list "Use a trolley to transport sheets" or "Use a two-person lift technique."
  • For dust: list "Use a wet-cutting method to suppress dust" before you write "Wear a dust mask."

Inspectors will look for evidence that you reviewed the hazards of the specific location.

Focusing Only on PPE

A SWMS that lists only gloves, glasses, and hi-vis shirts as control measures is usually non-compliant. The WHS Regulations require you to demonstrate how you are managing the risk at the source. PPE is the last line of defence. If your document does not mention engineering or administrative controls, it is considered inadequate.

Failing to Keep It On Site

The SWMS must be readily accessible to workers. Keeping the PDF locked in a file cabinet at the office does not help the crew on site. Ignoring Changes

If something changes on site, you must update the SWMS. If it starts raining heavily and creates a slip hazard, or if you decide to bring in a crane to lift a heavy gate, you need to stop and amend the document. Working to an outdated plan is a breach of the Act.

The law requires that workers acknowledge they understand the SWMS before work commences. A worker's signature is their confirmation that they have been consulted and trained. Faking signatures or failing to get them is a serious offence.

State Variations

While most of Australia follows the harmonised WHS laws, there are differences you must know.

  • New South Wales, Queensland, Tasmania, Australian Capital Territory, Northern Territory: These jurisdictions follow the model WHS Act and Regulations closely. SWMS are mandatory for HRCW.
  • Victoria: Victoria operates under the Occupational Health and Safety Act 2004. While the terminology is slightly different, the requirements are similar. In Victoria, fencing work is defined as "Construction Work" under the Occupational Health and Safety Regulations 2017. You must prepare a "Safe Work Method Statement" for specific high-risk activities. Sometimes this is called a Job Safety Analysis (JSA), but the content requirements are effectively the same.
  • Western Australia: WA uses the Occupational Safety and Health Act 1984 for general industry, but construction is increasingly covered by harmonised regulations through the Work Health and Safety (General) Regulations 2022. For fencing work involving high risks, you must follow the national model requirements for SWMS.

Privacy and Records

Your SWMS will contain personal information like worker names and signatures. Under the Privacy Act 1988, you have a duty to handle this information securely. You do not need to register the document, but you should store it securely and only share it with relevant parties like clients or inspectors.
