The employees of Construct Well Pty Ltd

1. TITLE AND PARTIES

This agreement is the Construct Well Pty Ltd Enterprise Agreement 2024.

The parties to this agreement are:

(a) Construct Well Pty Ltd (the Employer); (b) All employees of the Employer who perform work in the residential construction classification at the Melbourne depot.

2. OPERATION AND DURATION

This agreement operates from the 1st July 2024 and expires on the 30th June 2028.

This agreement covers the employment relationship between the Employer and the Employees. It replaces the Building and Construction General On-site Award 2020.

3. COVERAGE AND CLASSIFICATIONS

This agreement covers all employees engaged in the following roles:

• Trade Qualified Carpenter: Responsible for structural framing, fixing, and finishing work. Can read plans and work unsupervised.
• Labourer: Responsible for site cleaning, material handling, and assisting trades.
• Apprentice Carpenter: Employees undertaking a CPC30220 Certificate III in Carpentry.

Employees will be classified in one of these levels based on the skills required for their job.

4. HOURS OF WORK

Ordinary hours of work are 38 hours per week, to be worked between 7:00 am and 3:30 pm, Monday to Friday.

Meal breaks are 30 minutes unpaid, taken no later than 1:00 pm. Start and finish times can be shifted by mutual agreement to suit site conditions.

5. RATES OF PAY

The minimum weekly wages for full-time employees are:

• Trade Qualified Carpenter: $1,550.00 per week.
• Labourer: $1,200.00 per week.
• Apprentice Carpenter 1st Year: $650.00 per week.

These rates include all casual loadings, allowances, and penalties paid under the Building and Construction General On-site Award 2020. Comparison tables attached as Schedule A confirm employees are better off overall.

6. OVERTIME AND PENALTIES

Overtime is paid when an employee works outside ordinary hours.

• Monday to Friday (before 7am or after 3:30pm): 200% of the ordinary rate for the first two hours, 250% thereafter.
• Saturday: 200% of the ordinary rate.
• Sunday: 250% of the ordinary rate.
• Public Holidays: 250% of the ordinary rate.

Employees may take TOIL at the overtime rate. TOIL must be taken within 4 weeks.

7. ANNUAL LEAVE

Employees accrue 4 weeks of paid annual leave per year. A 17.5% leave loading is paid.

Leave may be taken at a time agreed with the Employer. Shutdown periods occur between Christmas and New Year.

Employees can cash out up to 2 weeks of annual leave.

8. PERSONAL LEAVE

Full-time employees accrue 10 days of personal carers leave per year.

Employees must notify the Employer by 9:00 am on the day of absence. Evidence is required for absences longer than 2 days.

9. CONSULTATION AND DISPUTE RESOLUTION

The Employer will consult with employees about major workplace changes, including redundancy.

Dispute procedure:

1. Talk to supervisor.
2. Talk to Site Manager.
3. Refer to Fair Work Commission.

10. WORKPLACE HEALTH AND SAFETY

The Employer and employees agree to comply with the Occupational Health and Safety Act 2004 (Vic).

Employees must wear steel-capped boots and high-vis vests at all times on site.
