ENTERPRISE AGREEMENT

1. TITLE AND PARTIES

This agreement is the [Name of Business] Enterprise Agreement [Year].

The parties to this agreement are:

(a) [Name of Business] (the Employer); (b) All employees of the Employer who perform work in the [Industry/Trade] classification at the [Location] workplace.

2. OPERATION AND DURATION

This agreement operates from the [Date] and expires on [Date (4 years later)].

This agreement covers the employment relationship between the Employer and the Employees. It replaces the [Name of relevant Modern Award].

3. COVERAGE AND CLASSIFICATIONS

This agreement covers all employees engaged in the following roles:

  • [Trade Role Level 1]: Responsible for [Description of duties].
  • [Trade Role Level 2]: Responsible for [Description of duties] and supervising Level 1.
  • [Apprentice]: Employees undertaking a training contract.

Employees will be classified in one of these levels based on the skills required for their job.

4. HOURS OF WORK

Ordinary hours of work are [Number] hours per week, to be worked between [Start Time] and [Finish Time], Monday to Friday.

Meal breaks are [Number] minutes unpaid, taken no later than [Time] hours after starting work.

5. RATES OF PAY

The minimum weekly wages for full-time employees are:

  • [Trade Role Level 1]: $[Amount] per week.
  • [Trade Role Level 2]: $[Amount] per week.
  • [Apprentice 1st Year]: $[Amount] per week.

These rates include all casual loadings, allowances, and penalties paid under the relevant Award. Employees are better off overall under these rates.

6. OVERTIME AND PENALTIES

Overtime is paid when an employee works outside ordinary hours.

  • Monday to Friday (after hours): [Percentage]% of the ordinary rate.
  • Saturday: [Percentage]% of the ordinary rate.
  • Sunday: [Percentage]% of the ordinary rate.
  • Public Holidays: [Percentage]% of the ordinary rate.

Employees may take time off in lieu of overtime (TOIL) by written agreement.

7. ANNUAL LEAVE

Employees accrue [Number] weeks of paid annual leave per year.

Leave may be taken at a time agreed with the Employer. The Employer will not unreasonably refuse a request.

Employees can cash out up to [Number] weeks of annual leave in a 12-month period. The cash out rate must be at least the full rate that would have been paid.

8. PERSONAL LEAVE

Full-time employees accrue [Number] days of personal carers leave per year.

Employees must notify the Employer as soon as possible if they are unfit for work. Evidence (like a medical certificate) is required for absences longer than [Number] days.

9. CONSULTATION AND DISPUTE RESOLUTION

The Employer will consult with employees about major workplace changes.

If a dispute arises about this agreement, the parties will:

  1. Talk to each other to try to solve it.
  2. If unresolved, refer the matter to a manager.
  3. If still unresolved, refer the matter to the Fair Work Commission.

While a dispute is being resolved, work continues as normal unless there is a safety risk.

10. WORKPLACE HEALTH AND SAFETY

The Employer and employees agree to comply with the Work Health and Safety Act 2011.

Employees must follow all safety procedures and wear Personal Protective Equipment (PPE) provided.
